Terms and Conditions

These Terms and Conditions govern your use of the Holo Vaults platform operated by Holo Vaults (ABN 94 106 090 391) at holovaults.com.au. These Terms are governed by the laws of Victoria, Australia. By accessing or using the platform you agree to be bound by these Terms.

You must be at least 18 years of age, or have the consent of a parent or legal guardian, to use Holo Vaults. By creating an account you warrant that you meet this requirement.

You must provide accurate and current information when registering. Only one account per person is permitted. You are responsible for maintaining the confidentiality of your password and for all activity on your account. Holo Vaults may suspend or terminate accounts that breach these Terms.

Sellers warrant that they have legal title to all items listed for sale. All listings must accurately describe the item, including condition, grade, and any known defects.

Prohibited items include: counterfeit cards, resealed product represented as sealed, stolen goods, and items infringing third-party intellectual property. Sellers must dispatch sold items within 3 business days of sale confirmation.

Holo Vaults charges a platform fee of 4.5% of the sale price (GST inclusive where applicable). Payment processing fees are additional and disclosed at checkout. All prices are in Australian Dollars (AUD). Seller payouts are processed within 2 business days of delivery confirmation.

Nothing in these Terms limits or excludes any rights consumers have under the Australian Consumer Law (Competition and Consumer Act 2010, Cth). Goods sold through the platform carry statutory consumer guarantees that cannot be excluded. For major failures consumers are entitled to a replacement or refund. For minor failures the seller may repair or replace the item. Any term of these Terms that attempts to exclude rights under the ACL is void to the extent of that exclusion.

Buyers may raise a dispute within 7 days of confirmed delivery for items that are not as described or not received. Holo Vaults will mediate disputes in accordance with its ACL obligations. Holo Vaults is not responsible for items lost in transit where tracking confirms dispatch.

Pokémon and all related names, images and trademarks are the property of Nintendo, Creatures Inc., and GAME FREAK inc. Holo Vaults is a resale marketplace and is not affiliated with or endorsed by The Pokémon Company. Holo Vaults platform content, branding and design are owned by Holo Vaults and may not be reproduced without permission.

You must not:

• Scrape, copy or systematically extract content from the platform
• Attempt to circumvent fees by transacting off-platform
• Harass, threaten or abuse other users
• Submit false, misleading or deceptive listings
• Engage in price manipulation, wash trading or shill bidding
• Use the platform for money laundering or any illegal purpose

To the maximum extent permitted by Australian law, Holo Vaults limits its liability to the total amount of fees paid by you in the 12 months preceding the claim. Holo Vaults is not liable for indirect, consequential, or incidental losses. Nothing in this clause limits or excludes your rights under the Australian Consumer Law.

Where Holo Vaults is required to charge GST under the A New Tax System (Goods and Services Tax) Act 1999, prices displayed will be GST-inclusive.

Holo Vaults may update these Terms from time to time. We will notify registered users of material changes. Continued use of the platform after notice of changes constitutes acceptance of the updated Terms.
